Currently, when a truck arrives at the Port and the required cargo information has not been transmitted to CBP, the truck
is turned around unless the driver is able to present proof that the required electronic cargo information was sent to an ABI filer prior to the arrival. With the implementation of the Automated
Commercial Environment (ACE) the carrier now has the ability to transmit advance electronic cargo information
via the ACE E-Manifest system.
Effective January 2, 2007,
carriers arriving in the Port of Buffalo without an E-Manifest and shipments that fail to meet the trade act requirements (data electronically transmitted to CBP within the hour prior to arrival - half hour for FAST shipments), will be denied permit to proceed and returned to Canada.
Carriers that arrive with an E-Manifest (or valid attempt) where shipments are not transmitted in advance of arrival will be referred
to secondary. Once the required cargo information is received, the conveyance and cargo will be processed in accordance with existing procedures.
In order to be eligible, drivers must provide proof of a valid ACE E-manifest (transponder and cover sheet) or proof that
they believed they had successfully transmitted one. This proof can be supplied in the form of an appropriately annotated CBP Form 7533, an E -Manifest cover sheet, and/or appropriate screen print of
the activity. Any noted abuses of this exception supported with false or erroneous documentation will be subject to penalty action.
